Indianapolis, Indiana Parole and Probation Lawyer Allen Lidy answers:
What is the difference between probation, parole, and pardon?
Probation and parole are similar in that they both impose a set of conditions upon a person in exchange for keeping them out of jail or prison. Probation is a court-imposed order usually given as an alternative to jail time as an opportunity for a person to make amends for any infractions. If probation rules are violated, an offender may receive a harsher probation sentence or be given jail time. In contrast, parole is extended to a prisoner by a parole board as a set of rules to be followed while a prisoner is allowed to serve the remainder of his sentence outside of prison. A parole violation can result in the offender being returned to prison. Both probation and parole conditions can cover a variety of requirements from regular check-ins with law enforcement officials to periodic drug tests. A pardon is a excusal of the crime by a high-ranking elected official in the jurisdiction that forgives, but does not clear, a criminal record. A pardon can take place either while the convicted person is in prison or after he has completed his sentence.
